TERMS OF SERVICE

Payment Terms. All payments for reading requests must be tendered in advance or cash on delivery. Direct credit card and e-transfer payments accepted. Please direct your payment preference type to Resonance Intuitive Arts at the time of your service request. Please note that payment transfers are done through the third party platforms Square (for credit cards) and Interac e-Transfer, so please be familiar with the privacy policy and terms of use for these third party platforms. Resonance Intuitive Arts is not liable for any mishandling by these third party platforms. In the event of third party mishandling, your claim will be with Square or Interac e-Transfer directly. Resonance Intuitive Arts does not accept checks or money orders. If your credit card is declined or payment is not properly transferred due to deficiencies on your end, then Resonance Intuitive Arts will be entitled to the balance owed plus a 25% interest as additional charge for the deficiency. 


Cancellation Policy. For in-person sessions by appointment, to cancel you must send the cancellation notice to Resonance Intuitive Arts at least 24 (twenty-four) hours in advance of the appointment. Otherwise you will be bound to pay the session price even if you do not show up for your session.


Service Requested is Not Time Sensitive. You understand and acknowledge that the service you have requested is not urgent and that time is not of the essence. If, however, your inquiry is urgent or time-sensitive, then separate, additional, written arrangements need to be made with Resonance Intuitive Arts. If no such documented, written arrangements are made on timing of delivery, then you hereby assure us that your request and needs are not time-sensitive. Regardless, every effort will be made to respond to you in a timely manner.


Refund Policy for Services. At Resonance Intuitive Arts we value one-to-one personalized care, supported by a spiritual point of view. You are requesting a spirituality-based service tendered from experience, specialized knowledge, and personalized attention. Thus, our services are non-refundable. All service fulfillments are final. Nonetheless, we at Resonance Intuitive Arts want to ensure that you glean the most value from your spiritual experience with us, and so if you have any questions or concerns, please do not hesitate to reach out. We would be more than happy to attend to you and see what we can do to resolve any concerns you may have.


Scope of Services. Your experience with Resonance Intuitive Arts in no way replaces professional counselling from a licensed counsellor or therapist and cannot be relied upon in lieu of sound legal, medical, or financial advice from licensed or qualified professionals. Resonance Intuitive Arts in no way diagnoses problems, but rather, suggests creative and intuitive perspectives for understanding your current situation, to help you come up with actions you can take to empower yourself in a way that will maximize your personal and professional potentials. Resonance Intuitive Arts strives to help you improve the quality of your life by tapping into your creativity and intuition.


Disclosure of Limitations. The spirituality-based services of Resonance Intuitive Arts should never be used in place of professional counselling. Your reading cannot offer legal, medical, business, or financial advice nor does any portion of your reading from Resonance Intuitive Arts purport to do so. You should not rely on any such spirituality-based service to make any decision that would affect your legal, financial, or medical condition. If your inquiry involves the law, finance, or medicine, then you should seek the advice of a licensed or qualified legal, financial, or medical professional. An intuitive professional cannot predict the future with certainty and any choices you make or actions you take as a direct or indirect result of your reading are solely your responsibility. Also, spirituality-based services by Resonance Intuitive Arts cannot replace qualified mental health care. An intuitive reading can only facilitate how you cope spiritually with a given situation.


Video Reading Recordings. Resonance Intuitive Arts may, at your option, provide video conference consultations or sessions through third party platforms or hosts, such as Zoom, Skype or Google Hangout. Before consenting to a video session, please go over any questions or concerns you may have with Resonance Intuitive Arts. By commencing a video session, you are consenting to the terms herein. Likewise, please be advised that you are not permitted to record video sessions without express, written permission from Resonance Intuitive Arts. If you would like to record your video session, then please ask before doing so. Reasonable accommodation or arrangements can then be made accordingly.


Confidentiality. Resonance Intuitive Arts exercises reasonable diligence in maintaining the confidentiality of your sessions and we will not voluntarily, knowingly, intentionally, or willfully disclose your identity or the contents of your sessions with us to third parties. However, if Resonance Intuitive Arts genuinely believes disclosure is required to: (1) prevent imminent harm or risk of harm to yourself or to another, (2) meet any applicable law, regulation, legal process, or governmental request, or (3) protect or defend Resonance Intuitive Arts against claims or threats of claims, then Resonance Intuitive Arts reserves the right to do so to the extent reasonably necessary. Please keep in mind that no legally recognized privilege exists between an intuitive professional and client the way a privilege might exist between an attorney and client, doctor and patient, husband and wife, or priest and penitent. 


Fortune Telling Laws. Pursuant to applicable laws of certain jurisdictions, a person can be guilty of fortune telling, still outlawed in certain places, when for a fee or compensation, that person claims or pretends to tell fortunes, or holds him or herself out as being able, by claimed or pretended use of occult powers, to answer questions or give advice on personal matters or to exorcise, influence, or affect evil spirits or curses, unless otherwise done so explicitly for entertainment purposes only. Any and all services provided by Resonance Intuitive Arts neither claims nor pretends to tell fortunes and neither claims nor pretends to use occult powers in ways that would run against such laws. 


For Entertainment Purposes Only. In certain jurisdictions, the spirituality-based services provided by Resonance Intuitive Arts would require a clear disclaimer that such services are for entertainment purposes only. Thus, if such a law applies to any sessions between us, then you are hereby on notice that our session is and can only be for entertainment purposes only. Irrespective of the law, we treat our spiritual connection with you with reverence and integrity. 


Reservation of Right. From time to time, as would be ordinary for any business, Resonance Intuitive Arts may modify the Terms of Service and we reserve the right to do so at our discretion accordingly. The terms your service with us will be bound by will be the terms applicable at the time your service was rendered.

CODE OF ETHICS

Mission


An intuitive professional strives to uphold the highest ethical standards in all services rendered and to act affirmatively toward maintaining public trust in the intuitive profession. An intuitive professional’s practice is grounded on use of divination as a tool to assist clients with tapping into their own intuitions, spirituality, or creativity.

Article One | Professionalism


Adherence to Applicable Laws. An intuitive professional will take the initiative to be knowledgeable of all applicable laws including but not limited to fortune telling statutes and local municipal codes that may cover their business or practice. 


Scope of Profession. The intuitive professional applies divination in a way that falls outside the scope of occult sciences and is not reading in a manner that claims or purports to tell fortunes, or with the ability to foretell with any certainty future events, or disclose in unequivocal terms the mental faculties of any persons.


Role of the Intuitive Professional. The intuitive professional provides a client with spiritual guidance and serves to empower the client toward making more spiritually empowered decisions for him or herself within the framework of the client’s own personal spiritual beliefs or practices. 


Limitations. An intuitive professional shall never claim the ability to cure another of ailments outside the lawful practice of medicine or provide financial benefits outside the lawful practice of financial analysis and management. The intuitive professional shall never purport to offer legal, medical, or financial advice. Unless the intuitive professional also possesses the applicable educational background, licensures, certifications, and/or qualifications to be a psychologist, therapist, counsellor, or other mental health professional, he or she shall not purport to be one. 


Referrals to Qualified Professionals. An intuitive professional owes a reasonable duty of care to his or her client and if an inquiry touches upon legal matters, even by a tangential connection or in passing, the intuitive professional will refer the client to seek the counsel of a licensed attorney. If an inquiry touches upon health or medical matters, even by a tangential connection or in passing, the intuitive professional will refer the client to seek diagnosis by a licensed medical doctor. If an inquiry touches upon financial or real property matters, even by a tangential connection or in passing, the intuitive professional will refer the client to seek advice from a qualified financial consultant, analyst, or real estate professional.  


Duty to Reject Subsequent Reading Requests. If at any time an intuitive professional believes or has reason to believe that a client is using intuitive readings to substitute, and not merely supplement, counselling from a qualified mental health professional, then he or she has a duty to reject subsequent reading requests from the client and to refer the client to seek qualified mental professional support. However, intuitive readings may be used as a supplement to qualified counselling or serve the function of life coaching or general spiritual guidance.


No Dishonesty, Fraud, Deceit, or Misrepresentations. An intuitive professional shall not use divination in a way that purports definitive and absolute knowledge of the future or of matters that are otherwise hidden or occult. The intuitive professional shall never guarantee any one outcome, positive or negative. An intuitive professional shall never engage in deceptive business or unfair trade practices. An intuitive professional shall make no misrepresentations about his or her competency, certifications, qualifications, or abilities. 


Third Party Consent. An intuitive professional is discouraged from providing reading services on inquiries into the personal affairs, business, intentions, mental faculties, or activities of third parties who are not present for the reading. However, an intuitive professional may provide reading services on inquiries about how the client’s affairs, business, intentions, mental faculties, or activities might be affected by that third party.

Article Two | Communications


The Reading Process. An intuitive professional is encouraged to make reasonable efforts to communicate his or her reading or interpretive process and analytical or intuitive methods, particular traditions, or the interpretive framework utilized. An intuitive professional will refrain from communicating to a client about curses or the manifestation of malicious intentions through supernatural or occult means.


Disclosures. An intuitive professional shall make reasonable efforts to disclose to all clients that intuitive readings cannot replace the counselling services of a mental health professional, and an intuitive professional can never guarantee his or her accuracy in the interpretation of a reading. Also, if and when intuitive practice would be explicitly barred by a jurisdiction’s applicable laws, then the intuitive professional must communicate to the client in clear, unambiguous terms that such readings are to be for entertainment purposes. See also Article Five, Disclosures.


No Duty to Retain Records. An intuitive professional does not owe a client any duty to retain the client’s reading records. An intuitive professional may, at the discretion of his or her customary practice, retain records or files on client readings.


Records Retention. If an intuitive professional does elect to retain client records, then he or she must develop and maintain appropriate record-keeping systems for storing his or her clients’ personal information in a manner that will reasonably preserve the clients’ confidentiality and privacy.



Article Three | Fees


Statement of Fees. An intuitive professional shall state his or her service fees before the start of a reading and cannot later raise or increase the stated fee unless prior contractual terms allow for the increase. The intuitive professional must clearly communicate his or her fee schedule and payment terms prior to the commencement of any reading. A fee for any service that is $500.00 CAD or more must be contractually agreed upon in writing.


No Pressure for Additional Services. An intuitive professional shall never pressure, compel, or even imply to clients that additional paid services from him or her are needed after the reading. An intuitive professional shall never purport to possess the power to manipulate the outcome of events through supernatural or occult means. 


Referral Fees. If an intuitive professional makes a referral, then he or she must disclose whether any referral fees have been paid as compensation or consideration for the referral.



Article Four | Confidentiality


Duty of Confidentiality. Although there is not likely to be a legal evidentiary privilege between an intuitive professional and client, an intuitive professional nonetheless agrees on his or her own accord to be bound by a duty of confidentiality. An intuitive professional shall not reveal personal or private information relating to a client reading unless that client has given informed consent. 


Reasonable Diligence to Protect Confidentiality. The intuitive professional shall exercise reasonable efforts to prevent the inadvertent or unauthorized disclosure of or access to information relating to his or her clients, which includes password protection to any electronic accounts, computers, or data storage units that would include client files and lock and key to any physical storage units containing hard copy files.


Exceptions. However, intuitive professionals may reveal personal or otherwise private information relating to a client reading if the intuitive professional reasonably believes it is necessary to prevent substantial bodily harm or death, or a court order overrides the confidentiality. Partial information from an  intuitive reading may be disclosed under the client’s anonymity for academic, civic, census, survey, or research purposes.

Article Five | Disclosures


General Practice Disclosures. An intuitive professional shall post a disclosure statement prominently at office locations, storefronts, on websites, reading venues, or commercial marketing materials that states essentially as follows:

Confidentiality of Information Submitted Electronically. While Resonance Intuitive Arts exercises reasonable efforts to maintain your confidentiality, electronic communications over the Internet are not always secure. Resonance Intuitive Arts has no control over what third parties might do with electronically transmitted personal information.
